Terms of Service

1. Introduction

These Terms of Service ("Terms") form a legally binding agreement between Red Dirt Solutions (ABN 59 255 747 260) – "we", "our", "us" – and the person or entity accessing ClassroomOS – QuizGrid ("you"). By accessing or using the QuizGrid website or any associated services (collectively "Service"), you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

• The Service is intended for users 16 years or older. By using the Service you confirm that you are at least 16, or that a teacher or school administrator has authorised your account on your behalf.
• If you are using the Service on behalf of a school or organisation, you represent that you have authority to bind that organisation to these Terms.

3. Account Registration & Security

• You may sign in via Google or Microsoft OAuth or create a local account. You are responsible for all activity that occurs under your credentials.
• You must keep your login details secure and notify us immediately of unauthorised use.

4. Licence & Intellectual Property

• We grant you a non‑exclusive, revocable, non‑transferable licence to access and use the Service for educational or internal business purposes.
• Ownership of Quizzes. All quizzes, prompts and other content generated by the Service ("Generated Content") are automatically assigned to Red Dirt Solutions. We grant you a worldwide, royalty‑free licence to use, copy, display and redistribute Generated Content for any lawful purpose.
• All other intellectual property in the Service (including the names "ClassroomOS" and "QuizGrid") remains our property. Nothing grants you any right to use our trademarks without permission.

5. User Content & Acceptable Use

• You may upload images or other materials ("User Content") provided it is school‑appropriate and does not infringe any rights or laws.
• Forbidden uses include: hateful, harassing, defamatory, obscene, pornographic, violent, or illegal content; attempts to cheat or facilitate academic misconduct; reverse‑engineering or disrupting the Service.
• We employ automated filters and may perform manual reviews. We may immediately suspend or ban any user who breaches these Terms.

6. Service Availability & Changes

• The Service is provided free of charge "as‑is" with no uptime guarantee. Features may change or be withdrawn at any time without notice.

7. Third‑Party Services & AI

• The Service relies on third‑party providers including OpenAI, Google reCAPTCHA and Google Analytics. Use of the Service therefore subjects you to those providers' terms and privacy practices.
• AI output may contain errors or "hallucinations". You must review and verify all Generated Content before relying on it in class or elsewhere.

8. Disclaimer & Consumer Guarantees

Except for non‑excludable guarantees under the Australian Consumer Law (ACL), the Service is provided without warranties of any kind. To the extent permitted by law we exclude all implied warranties and conditions.

9. Limitation of Liability

• To the fullest extent permitted by law, our liability for any claim arising out of or in connection with the Service is limited to AUD $1 (one dollar).
• We are not liable for indirect, consequential, exemplary, punitive or special damages, or for loss of data, profits or goodwill.

10. Indemnity

You agree to defend, indemnify and hold Red Dirt Solutions harmless from any claims, costs or liabilities arising out of your use of the Service or breach of these Terms.

11. Termination

• You may terminate your account at any time by deleting it or emailing [email protected].
• We may suspend or terminate your access immediately for any breach, suspected abuse or at our sole discretion. We are not obliged to provide data export.

12. Governing Law & Dispute Resolution

• These Terms are governed by the laws of New South Wales, Australia.
• Before court proceedings, the parties must attempt good‑faith negotiation. Each party bears its own costs.
• Courts of NSW have exclusive jurisdiction.

13. Changes to Terms

We may update these Terms at any time. Changes take effect immediately upon posting. Continued use after changes means acceptance.
